These Terms of Service (“Terms”) govern your access to and use of https://acimpressions.com/home including its pages, forms, content, resources, appointment-scheduling functions, email communications, text-message services, and related features collectively referred to as the “Website” or “Services.”
The Website and Services are owned and operated by Artistic Concrete Impressions & Construction dba ACI Construction, referred to in these Terms as the “Company,” “we,” “us,” or “our.”
1. Acceptance of These Terms
By accessing or using the Website, submitting information through the Website, creating an account, scheduling an appointment, downloading a resource, or otherwise using the Services, you acknowledge that you have read, understood, and agreed to be bound by these Terms and our Privacy Policy.
Participation in our SMS or text-message program is voluntary and subject to the additional SMS Program Terms contained below.
Merely visiting the Website does not enroll you in our SMS Program. Enrollment in recurring SMS communications requires a separate affirmative opt-in.
If you do not agree with these Terms, you must not use the Website or Services.
2. Eligibility and Age Restrictions
You must be at least 18 years old and have the legal capacity to enter into a binding agreement to use the Website or participate in the SMS Program.
If the age of legal majority in your jurisdiction is greater than 18, you must have reached the age of majority in that jurisdiction.
By using the Website or enrolling in the SMS Program, you represent and warrant that:
You meet the applicable minimum-age requirement;
You have the legal authority to accept these Terms;
The information you provide is accurate and complete; and
You are the account holder or authorized user of any telephone number or email address you provide.
The Website and SMS Program are not directed to children or minors.
3. Description of the Website and Services
The Website provides information concerning construction, disaster mitigation, including: Fire Mitigation and Restoration, Water/Flood Damage mitigation and restoration, Mold Remediation, and facility restoration.
Depending on the features available through the Website, users may be able to:
Request information about our products or services;
Contact the Company;
Schedule appointments or consultations;
Register for workshops, webinars, meetings, or events;
Download reports, assessments, guides, or educational materials;
Subscribe to email or SMS communications;
Submit questions or comments; and
Access other content or services made available by the Company.
We may add, modify, suspend, restrict, or discontinue any portion of the Website or Services at any time, subject to applicable law.
4. SMS Program Description
The ACI Info text-message program is operated by ACI CONSTRUCTION.
Individuals who affirmatively opt in may receive SMS or MMS text messages at the mobile telephone number they provide.
Depending on the specific consent provided and the user’s relationship with us, SMS messages may include:
Responses to inquiries or requests for information;
Appointment confirmations and reminders;
Appointment rescheduling or cancellation notices;
Workshop, webinar, meeting, or event confirmations;
Event reminders, access instructions, or schedule changes;
Requested reports, links, resources, or educational information;
Customer-service and support communications;
Service-related notices and administrative updates;
Follow-up communications concerning an inquiry, consultation, purchase, or existing business relationship;
News, announcements, educational content, and business updates;
Special offers, promotions, or marketing messages when the recipient has provided the required consent; and
Other messages specifically described at the time the user opts in.
The nature of the messages you receive will depend on the specific SMS Program, form, keyword, or communication for which you enrolled.
We will not materially expand the SMS Program beyond the message types described at the point of enrollment without providing any additional notice or consent required by applicable law.
5. SMS Enrollment and Consent
You may enroll in the SMS Program through one or more methods made available by the Company, including:
Providing your mobile telephone number and affirmatively selecting an SMS consent checkbox;
Texting a designated keyword, such as START, JOIN, or another published keyword, to our sending number;
Completing an electronic or written consent form;
Requesting SMS communications during an appointment or other interaction; or
Using another clearly disclosed affirmative opt-in process.
By affirmatively opting in, you authorize the Company to send the types of text messages described at the point of enrollment to the mobile telephone number you provided.
Messages may be sent using automated technology, including an automated telephone dialing or text-messaging system, to the extent permitted by applicable law.
Where required, your consent will include authorization to receive marketing or promotional messages. Consent to receive promotional text messages is not a condition of purchasing any product, service, or property from the Company.
Applicable FCC regulations define prior express written consent for covered telemarketing as a written agreement clearly authorizing the messages and require disclosure that the agreement is not a condition of purchase. Electronic or digital signatures may qualify where legally recognized.
Your SMS consent applies only to the mobile number you provide. You agree not to provide a telephone number unless you are the subscriber, account holder, or authorized user of that number.
6. Message Frequency
Message frequency varies.
The number and timing of messages may depend on:
The SMS Program in which you enrolled;
Your interaction with the Company;
Upcoming appointments or events;
Services you requested;
Questions or messages you send to us;
Your communication preferences; and
The frequency disclosed at the point of enrollment.
For a recurring promotional program, you may receive approximately [INSERT NUMBER OR RANGE] messages per [WEEK/MONTH], although message frequency may vary.
Messages may be recurring until you opt out.
7. Message and Data Rates
Message and data rates may apply.
The Company does not ordinarily charge a separate fee to participate in the SMS Program. Your wireless carrier, however, may charge messaging, data, roaming, or other fees under your mobile-service plan.
You are responsible for all charges imposed by your wireless carrier in connection with sending or receiving SMS or MMS messages.
Contact your wireless carrier if you have questions about your messaging or data plan.
8. SMS Opt-Out Instructions
You may withdraw your SMS consent and unsubscribe from the SMS Program at any time.
To opt out, reply:

to any text message received from the Company or text STOP to [SMS SENDING NUMBER].

We will process valid opt-out requests as soon as reasonably practicable and within the period required by applicable law.
After submitting an opt-out request, you may receive one final nonpromotional confirmation message stating that your request has been processed. No further recurring SMS Program messages will be sent unless you subsequently request messages or affirmatively enroll again.
The Company will also recognize other reasonable language that clearly communicates a desire to stop receiving messages, as required by applicable law. Current FCC regulations expressly recognize terms such as “stop,” “quit,” “end,” “revoke,” “opt out,” “cancel,” and “unsubscribe,” as well as other language a reasonable person would understand as withdrawing consent.
Your opt-out request will be applied in accordance with applicable law and the scope of the request. Unsubscribing from text messages does not automatically unsubscribe you from email communications unless you request removal from both channels.

Customer-support response times may vary. Text messaging should not be used for emergencies or other matters requiring an immediate response.
10. Carrier and Message-Delivery Disclaimer
The SMS Program may not be available through all wireless carriers, in all geographic locations, or on all devices. Supported carriers and technologies may change without notice.
Delivery of a text message is subject to effective transmission by your wireless carrier and network availability. Delivery may be affected by circumstances outside the Company’s control, including:
Wireless-network availability;
Carrier filtering or blocking;
Device compatibility;
Internet or cellular-service interruptions;
Incorrect or inactive telephone numbers;
Telephone-number reassignment;
System outages;
Geographic limitations; and
Other technical or operational conditions.
The Company does not guarantee that every message will be transmitted, received, or received within a particular period.
Wireless carriers are not liable for delayed or undelivered messages.
To the fullest extent permitted by law, the Company is also not liable for losses resulting solely from delayed, blocked, misdirected, incomplete, or undelivered messages caused by a wireless carrier, communications network, device, messaging provider, or other circumstance outside the Company’s reasonable control.
11. Telephone-Number Changes and Reassignment
You agree to provide a current and accurate mobile telephone number.
If you:
Stop using the telephone number;
Transfer the number to another person;
Change wireless carriers;
Lose authorization to use the number; or
Otherwise cease to be the authorized user of the number,
you must promptly unsubscribe by texting STOP before discontinuing use of the number or notify us through the support information listed in these Terms.
You agree not to enroll another person’s telephone number without that person’s authorization.
12. Privacy and SMS Information
Our collection, use, retention, safeguarding, and disclosure of personal information, including mobile telephone numbers and SMS consent records, are described in our Privacy Policy.
The words “Privacy Policy” above must be hyperlinked to the Company’s published Privacy Policy page.
Mobile telephone numbers, SMS consent records, and messaging information will not be sold, rented, or shared with third parties or affiliates for their own marketing or promotional purposes.
We may use contracted messaging platforms, telecommunications carriers, technology providers, and other service providers solely as reasonably necessary to operate the SMS Program, transmit messages, maintain consent and opt-out records, provide support, protect system security, and comply with applicable law.
13. User Responsibilities
When using the Website or Services, you agree to:
Provide accurate, current, and complete information;
Use the Website only for lawful purposes;
Respect the rights of the Company and other users;
Refrain from attempting to interfere with Website operation or security;
Refrain from submitting malicious code, malware, automated requests, or harmful content;
Refrain from impersonating another person or misrepresenting your identity or authority;
Refrain from collecting information about other users without authorization; and
Comply with all applicable federal, state, local, and international laws.
You may not use the Website or Services to engage in fraud, harassment, unlawful solicitation, intellectual-property infringement, unauthorized access, data scraping, security testing without written authorization, or any activity that could damage the Website or Company.

Unless otherwise stated, the Website and its content are owned by or licensed to the Company and are protected by applicable copyright, trademark, trade-secret, and other intellectual-property laws.

Assessments, reports, guides, and downloads;

Software and code;
Processes, methods, and frameworks; and

The Company grants you a limited, revocable, nonexclusive, nontransferable right to access and use the Website for your personal or internal business use.

THE COMPANY DISCLAIMS ALL EXPRESS, IMPLIED, AND STATUTORY WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, AND SECURITY.
WE DO NOT WARRANT THAT:
THE WEBSITE OR SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE;
DEFECTS WILL ALWAYS BE CORRECTED;
THE WEBSITE WILL BE FREE FROM MALICIOUS CODE;
TEXT MESSAGES WILL ALWAYS BE DELIVERED;
INFORMATION WILL ALWAYS BE COMPLETE OR CURRENT; OR
USE OF THE WEBSITE OR SERVICES WILL PRODUCE A PARTICULAR RESULT.
Some jurisdictions do not allow the exclusion of certain warranties. In those jurisdictions, these exclusions apply only to the extent permitted by law.
19. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE COMPANY AND ITS OWNERS, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AGENTS, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM OR RELATING TO:

DELAYED OR UNDELIVERED TEXT MESSAGES;
LOSS OF DATA, PROFITS, REVENUE, BUSINESS, OR GOODWILL;
UNAUTHORIZED ACCESS TO INFORMATION; OR
CONDUCT OF ANOTHER USER OR THIRD PARTY.
TO THE FULLEST EXTENT PERMITTED BY LAW, THE COMPANY’S TOTAL AGGREGATE LIABILITY ARISING FROM OR RELATING TO THE WEBSITE, SERVICES, OR THESE TERMS WILL NOT EXCEED THE GREATER OF:
The amount you paid directly to the Company for the specific Service giving rise to the claim during the six months preceding the event; or
One hundred U.S. dollars.
These limitations do not apply to liability that cannot legally be excluded or limited.
20. Indemnification
To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless the Company and its owners, officers, directors, employees, agents, contractors, and service providers from claims, losses, damages, liabilities, judgments, costs, and reasonable attorneys’ fees arising from:
Your unlawful or unauthorized use of the Website or Services;
Your material violation of these Terms;
Information or content you submit;
Your infringement of another person’s rights; or
Your misuse of another person’s telephone number or contact information.
This section does not require indemnification for conduct for which indemnification is prohibited by applicable law.
21. Suspension and Termination
We may restrict, suspend, or terminate your access to the Website or Services if we reasonably believe you have:
Violated these Terms;
Used the Services unlawfully;
Threatened Website or system security;
Misused another person’s information;
Engaged in fraudulent, abusive, or disruptive conduct; or
Exposed the Company or another party to legal or operational risk.
You may stop using the Website at any time. You may terminate your SMS participation by following the opt-out procedures in Section 8.
Provisions that by their nature should survive termination will remain effective, including intellectual-property provisions, disclaimers, limitations of liability, indemnification, and dispute-related provisions.
22. Changes to These Terms
We may update these Terms periodically to reflect changes in the Website, Services, SMS Program, technology, business practices, or legal requirements.
When we update the Terms, we will post the revised version and change the “Last Updated” date.
When required by applicable law, we will provide additional notice or obtain renewed consent before applying a material change to previously authorized SMS communications.
Your continued use of the Website after revised Terms become effective constitutes acceptance of the revised Terms, except where affirmative agreement is legally required.
23. Governing Law and Venue
These Terms are governed by the laws of the State of Colorado, without regard to conflict-of-law principles.
Subject to any consumer rights that cannot legally be waived, any legal proceeding arising from or relating to these Terms, the Website, or Services must be brought in the state or federal courts located in Denver, Colorado, and each party consents to the jurisdiction of those courts.
Nothing in this section deprives a consumer of nonwaivable rights available under applicable law.
24. Severability
If any provision of these Terms is found invalid, illegal, or unenforceable, that provision will be enforced to the greatest extent legally permitted or modified to reflect the original intent as closely as possible.
The remaining provisions will continue in full force and effect.
25. No Waiver
A failure by the Company to enforce any provision of these Terms does not waive the right to enforce that provision or any other provision later.
Any waiver must be in writing and signed by an authorized representative of the Company.
26. Entire Agreement
These Terms, together with the Privacy Policy and any additional written agreement applicable to a particular product or service, constitute the entire agreement between you and the Company concerning the Website and Services.
If a separate signed agreement conflicts with these Terms, the separate signed agreement controls with respect to the subject matter it addresses.
